The Pennsylvania Department of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on October 8, 2019. As a result of that inspection, and due to the severity of the specific violations the Mid-Town Pizza was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations.
Mid-Town Pizza also failed a regular inspection on November 7, 2017, with 12 violations. On November 5, 2018, the regular annual inspection found 11 violations. All tolled the restaurant hasn’t passed an annual inspection in 3 years.
The inspector made the following comments in support of the violations found during the inspection:
- The Person in Charge does not have adequate knowledge of food safety in this food facility as evidenced by this non-compliant inspection. Repeat Violation.
- Clean utensils stored in drawers that had sticky residue and debris in the drawers.
- Cleanliness of Hands-Food employees could not follow proper hand washing procedures due to lack of paper towels at the hand wash sinks in the ware wash and bar areas. Corrected
- Paper towels not available at the handwash sink in the ware wash area. Corrected.
- Observed a fly strip suspended from the ceiling directly above bags of flour.
- The ware wash area is extremely dirty and needs to be cleaned.
- Food employee observed in the bar area sanitizing washed glasses without a prior rinse.
- Deli meats, refrigerated, ready to eat, time/temperature control for safety food, located in the walk-in cooler, and held more than 24 hours, is not being marked with the date it was sliced.
- Observed moist residue and food debris on the floor of the walk-in cooler.
- Plastic coated material to close off the bin of the ice machine and a new condensing unit secured with duct tape, not an approved material.
- Hole in the wall at the hand wash sink in the ware wash area and studs are exposed.
- Air vent with static dust accumulation above the sandwich prep bain marie with the potential to contaminate food.
- Food facility does not have available chlorine sanitizer test strips or test kit to determine appropriate sanitizer concentration of the low temperature dish machine.
- The metal floor covering in the walk-in cooler is not secured and sub floor is exposed.
- Several floor tiles missing in the sandwich prep area and need replaced.
- A working container of cleaner type chemical was stored on the same shelf as food equipment.
- Ground beef and lasagna observed thawing at room temperature on the table, which is not an approved thawing method.

There are over 26,000 eating and drinking establishments in Pennsylvania, and thousands more convenience stores, grocery stores and schools required to be inspected by the Department of Agriculture and, in some cases, local government entities at least once a year. Out of more than 2,000 inspections each month only about 150 are found to be, “Out of Compliance.”
Violations leading to the Out of Compliance designation are more critical violations. Establishments can score a number of lower level violations without achieving the Out of Compliance designation.
